Terms of Service
These Terms govern access to ImpactGuard websites, the operations panel, APIs, and distributed plugin artifacts (collectively, the “Services”). By creating an account, downloading software, or using the Services, you agree to these Terms. The operator frames these Terms with respect to the laws of the Republic of Bulgaria and applicable European Union instruments where they apply.
Eligibility & Accounts
You must provide accurate registration information and safeguard your credentials. You are responsible for activity under your account.
Licenses
We grant you a limited, non-exclusive, non-transferable license to use the Services and plugin in accordance with your plan, documentation, and applicable export laws. Unless expressly permitted, you may not reverse engineer, circumvent technical protections, resell, or redistribute our software except as allowed by us in writing.
Acceptable Use
You will not misuse the Services: no unlawful activity, harassment, attempting to harm or overload infrastructure, unauthorized access to third-party systems, or evasion of enforcement decisions except through published appeal workflows.
Customer Obligations
You are responsible for compliance with laws applicable to your servers and communities, for obtaining necessary consents where required, and for configuring policies appropriate to your environment.
Third-Party Services
The Services may integrate with third-party payment processors, communication platforms, or hosting providers. Their terms may apply to those interactions.
Partners & WHMCS
Authorized partners may use panel features and optional automation (such as a WHMCS-oriented webhook) under the rules described in our Partnerships & WHMCS Integration page. Partner billing to end users remains the partner’s responsibility unless ImpactGuard is the direct seller of record.
Fees & Trials
Paid features are billed according to the plan you select. Taxes may apply. Failure to pay may result in suspension. Free or promotional offerings may change or end.
Refunds
We do not offer refunds. All fees for paid plans and renewals are non-refundable and charges are final once payment succeeds, except to the extent mandatory applicable law (including Bulgarian or EU consumer rules where they apply to you) requires a remedy we cannot lawfully exclude. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SECURITY TOOLS CANNOT GUARANTEE DETECTION OF ALL THREATS OR ABSENCE OF FALSE POSITIVES.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPACTGUARD AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR, IF NO FEES APPLIED, ONE HUNDRED US DOLLARS).
Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by mandatory law, including the laws of the Republic of Bulgaria or the European Union.
Indemnity
You will defend and indemnify ImpactGuard against claims arising from your misuse of the Services, your server operations, or violation of these Terms, subject to applicable law.
Suspension & Termination
We may suspend or terminate access for violations, risk to the platform, or non-payment. You may stop using the Services at any time. Provisions intended to survive will remain in effect.
Governing Law & Disputes
These Terms, and any non-contractual matters arising out of or relating to them, are governed by the laws of the Republic of Bulgaria, without regard to conflict-of-law rules that would apply the laws of another state.
Subject to mandatory provisions of Bulgarian or EU law that cannot be contractually waived (including consumer rights where applicable), the courts of Sofia, Bulgaria shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services. Before filing a claim, please contact [email protected] so we can try to resolve the issue informally.
Changes
We may modify these Terms by posting updates and adjusting the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
